Notice of Continuation of Court Order Prohibiting Breach of City of Windsor By-Laws
WINDSOR – On February 18, 2022, the Chief Justice of the Superior Court of Justice, Geoffrey B. Morawetz, made an order continuing the order previously granted on February 11, 2022, and varying its terms. The order granted today prohibits breaches of the following City of Windsor by-laws: By-Law 9148 (Traffic By-Law), By-law 233-2001 (Vehicle Idling By-Law), By-Law 25-2010 (Protection of Highways By-Law), By-Law 6716 (Noise By-Law) and By-Law 9023 (Parking By-Law). The order is binding on all persons who have notice of it and remains in effect until varied or discharged by a further order of the Court.
The order was granted at the request of the City of Windsor. The Attorney General of Ontario, Doug Downey, intervened in the court case and expressed his support for the granting of the order.
The order authorizes the police to remove any person contravening the order or any object being used in contravention of the by-laws, but specifies that the police retain discretion as to the timing and manner of enforcement.
