NOTICE OF INTENDED DECLARATION
Pursuant to section 176 of Ontario Regulation 30/11 made under the Funeral, Burial and Cremation Services Act, 2002
Re: Burial site at 3073 Centennial Crescent, Township of Kingsville, Geographic Township of Gosfield, Essex Country, Province of Ontario
Take Notice that on April 28, 2022, the discovery of a burial site was reported to the Registrar of Burial Sites under the Funeral, Burial, and Cremation Services Act, 2002 (Act), when human remains were discovered during construction on the subject property. The archaeological investigation identified the remains of one individual who had been interred on the property.
The Registrar hereby gives notice of the intention to declare the discovered site a Burial Ground under section 98 of the Act and invites representatives of the persons whose remains are interred in the burial ground to contact the Registrar within 30 days of the date of this notice.
Under the Act means land set aside with the apparent intention of interring in it, in accordance with cultural affinities, human remains and containing remains identified as those of persons who were not one of the aboriginal peoples of Canada; and
“representative,” in the case of a “burial ground,” means (i) a descendant of the interred person, or (ii) if there is no known surviving descendant, a representative of the religious denomination with which the interred person was affiliated as evidenced by the place of interment.
If the site is declared a ‘burial ground’ persons who meet the definition of “representative” and agree to be representatives will be entitled to receive notice of the burial ground declaration, and, once served with that notice, will need to negotiate a site disposition agreement with the landowner, in accordance with the Act and its regulations. If no persons agree to be identified as a representative of the persons whose remains are interred, the landowner will not be required under the Act to negotiate how the human remains from the burial ground are to be dealt with when ensuring their final disposition in a cemetery.
