Town Administration has received questions and concerns regarding the proposed By-law about power of entry to property, item L-3 on tonight’s Council agenda.
In light of the questions brought forward by the community, Administration has decided to withdraw the staff report and By-law from tonight’s agenda to provide opportunity to review these questions and concerns.
For clarity, power of entry is a discretionary power which enables designated Municipal Officials to access exterior lands (such as the backyard) or structures (such as greenhouses) during the course of a by-law enforcement investigation. It does not provide municipal officials with the authority to enter into a residential home, except in unusual circumstances such as an emergency or by Court Order.
Similar Power of Entry By-Laws are in force in other municipalities in Ontario.
